These Terms & Conditions ("T&Cs") are legally binding and are accepted automatically when registering an account at Designer Auction. To participate in these auctions you have to be over 18 years old. Only one user registration per household is permitted. Employees (including service providers) and relatives of employees of Designer Auction are not eligible to register and participate in auctions under any circumstances.
Designer Auction is present in several countries. Each country has its own local currency.
Designer Auction reserves the right to disqualify any user or bid at any point in time and at its sole discretion, without repaying the bid fee as well as cancel the auction/purchase if any of the following events occur:
Designer-auction.com reserves the right to limit the number of auctions a user may participate in at its sole discretion.
Bidding rights, so-called “bids”, must be purchased and paid for by users prior to placing bids. Bids can be purchased individually or in packages (the bigger the package the cheaper the cost of each bid), and can be viewed in “My Account”. Payments can be made by credit card or via payment methods such as PayPal and ClickandBuy. Designer Auction takes no responsibility for technical errors caused by the supplier of payment solutions and is not responsible if the bidder fails to process a transaction. If any kind of error occurs in a transaction it is the responsibility of the bidder to inform designerauction.co.uk immediately. Designerauction.co.uk does not allow the right to cancel purchased bids.
A bid at Designer Auction becomes valid when our system registers the placed bid in the database. Please note that the bids are not valid from when they are sent from the computer or mobile phone. It normally takes two or three seconds for the bid to become valid but on some occasions it may take longer. Designer Auction takes no responsibility for any kind of delay and its consequences, as it is out of our control. Designer Auction takes no responsibility for technical problems concerning third parties.
Users can choose between two ways of bidding. Bids can be placed by clicking on the relevant bid buttons, or can be placed automatically with the Autobidder. The Autobidder assists users in being able to bid on an auction even if they are not online at that time. The Autobidder will automatically submit bids according to the instructions set in advance by the user. The user can read about how to use an Autobidder in the “Help” section. Designer Auction does not allow to use any kind of bidding software, and doing so will result in immediate disqualification.
All auctions have a countdown timer which shows how much bid time remains. With each bid placed, the price of the item on which the user is bidding increases by £0.01 (one pence). Each new bid resets the “remaining time” for an auction up to the displayed countdown reset value (normally 1 minute). An auction ends when no new bids have been placed in the remaining time after the latest bid was placed. The extension period (reset value) may vary in special auctions. Designer Auction takes no responsibility for interruptions in the user's internet connection and the errors that may arise due to this, including the timer not counting down correctly or out of date information about the bidder or bid. When operational disturbances are suspected, Designer Auction reserves the right to pause all auctions and reserves the right to change the bid time during ongoing auctions and re-open closed auctions.
All reveal auctions are displayed with one start price, which is the respective product value. The actual purchase price is concealed until you place a bid. With each bid placed, the price decreases, so the actual purchase price is always less than the product value. This game works on a first come first serve basis. Once you have decided to buy an item, we advice to finalize the purchase process as quick as possible. If your payment does not come in first place, your money will be refunded automatically by our system.
Bidding is binding. A user who places the winning bid is contractually obliged to pay the item. Binding contracts arise between Designer Auction and the bidder who is the approved winner of the auction. When the auction ends, it is the responsibility of both Designer Auction and the buyer to ensure that the purchase is processed. Designer Auction is responsible to contact the winner of the auction and to send the item once it is paid. The buyer is obliged to pay the item within 15 calendar days. In cases when the bidder does not meet his liability to pay Designer Auction the winning bid is cancelled. The auction winner always pays for shipping cost.
The winner will be contacted by Designer Auction within 24 hours after the auction has ended. If Designer Auction is not able to contact the winner and the item is not paid within 15 calendar days, Designer Auction reserves the right to cancel the purchase.
Once the auction has ended, you pay the auction price and receive the item within 5-10 working days. Delivery is made via recorded courier service and is fully insured. Delivery costs are paid by the winner/buyer. Each auction will display indicative delivery costs, which on average cost 10-20 GBP, depending on the value of the item. For deliveries outside the UK, the cost can be higher. If you are not sure about the delivery costs to your country, please contact our customer service team. Designer Auction delivers only within Europe and the US. If you live in a different region, please contact our customer service before you bid, exceptions are possible. Designer Auction takes no responsibility for any delays of product delivery caused by any postal service. In rare cases a product which is auctioned off at Designer Auction can run out or no longer be in the manufacturer’s stock. In such cases Designer Auction has the right to replace this item with a similar product of an equal value. Designer Auction takes no responsibility for delays caused by the post or other suppliers.
Any requests for technical service or general support should be made directly to the manufacturer in accordance with their terms and conditions.
Designer Auction will run different promotions in newsletters, magazines, newspapers, television and radio, which all may only be valid for a limited time. When the advertised time limit of any such promotion has been reached, or the relevant auction has ended, the promotion is also finished.
The users expressly agree that the use of Designer Auction is at user’s sole risk. Designer Auction, its affiliates and third party service providers make no warranty as to the results that may be obtained from use of the website. No warranty is made as to the accuracy and content of any information or service provided through Designer Auction. Designer Auction takes no responsibility for any spelling mistakes regarding products or where a bid has not arrived or arrived late. The service will normally be operating 24 hours per day, seven days a week, but will have regular breaks for maintenance. In cases of operational disturbances, Designer Auction reserves the right to postpone the ending dates and times for any auction. Operational disturbances include problems with the internet connection or server, fraud, unauthorized access to the systems and service interruptions at the supplier. Designer Auction takes no responsibility for any overload of the website and any arising consequences. Designer Auction is not responsible for errors in computer programmes which influence the participation and takes no responsibility for changes in legislation which affect the auction and its realization.
The protection of your personal data is very important to us. All personal information is handled confidential and can at the user's request be removed from the database once the user account has been cancelled. The personal information will only be used to contact bidders when they have won, because of operational disturbances or to market services for Designer Auction. The user has the right to terminate his/her account at any time. Designer Auction reserves the right to publish the winner's Christian name and surname. Designer Auction reserves the right to change the T&Cs during ongoing bidding. The new T&Cs come into force upon being published.
Designer Auction reserves the right to transfer all or parts of the rights and responsibilities which are made clear in these T&Cs. During a transfer you will be informed who has taken over the rights and responsibilities. The bidder does not have the right to transfer rights or responsibilities in accordance with these T&Cs.
Designer Auction works together with subcontractors who are responsible for all products and respective guarantees. Designer Auction is not a retailer of the goods which are auctioned off and therefore is not responsible for guarantees and compensation claims. In cases of compensation or guarantee claims the auction winner is referred to the retailer in question. Designer-auction.com will assist in putting the parties in contact. The payment invoice works as a receipt.
Designer Auction is the owner or licensee of all intellectual property rights on the Designer Auction website and the material published on it. Those works are protected by copyright laws and treaties around the world and all rights relating to the same are reserved. Users are not allowed to use any part of the materials on the designer-auction.com website for commercial purposes.
The applicable law to these T&Cs is English law, as it is applied to contracts which have been agreed in England between English parties. Disputes regarding validity, interpretation, applicability or application of these T&Cs and out of those originating legal relations, shall be settled by a common court in England.
